MainePERS tracks proposed legislation related to the programs we administer during each legislative session. Below you will find the legislation introduced during the current session of the Maine Legislature. Included is a brief overview of the bill, a copy of the original proposed legislation (which is referenced by its legislative document [LD] number and title) along with any testimony submitted by MainePERS regarding the proposal.

LD 137 – An Act to Expand the 1998 Special Retirement Plan to Include Employees Who Work for the Office of Chief Medical Examiner
Summary: This bill would change the plan in which certain employees of the Office of Chief Medical Examiner participate from a regular plan to the 1998 Special Plan.
LD 462 – An Act to Amend the Eligibility Criteria for Creditable Service in the Armed Forces of the United States Under the Maine Public Employees Retirement System
LD 579 – An Act to Include Certain Mental Health Workers Under the 1998 Special Plan for Retirement
Summary: This bill would change the plan in which certain employees of the Department of Health and Human Services participate from a regular plan to a special plan.
LD 794 – An Act to Include Judicial Marshals in the 1998 Special Plan for Retirement
Summary: This bill would change the plan in which certain employees of the judicial branch participate from a regular plan to the 1998 Special Plan.
LD 900 – An Act to Protect State Retiree Pensions from Inflation
Summary: This bill proposes to increase the Cost of Living Adjustment (COLA) base and COLA percentage cap for the State/Teacher plan.
LD 1003 – An Act Establishing the Retirement Benefit Improvement Fund
Summary: This bill would create an account for the accumulation of funds to increase the COLA benefit base within the State/Teacher plan. Funds would be provided from year-end unappropriated General Fund surpluses.
LD 1021 – An Act to Remove Certain Cost-of-living Adjustment Restrictions for Retired Members of the Law Enforcement Bargaining Unit Who Are 65 Years of Age or Older
Summary: This bill would apply a 3% cost-of-living adjustment (COLA) to the entire benefit of certain retirees who retire at age 65 or older.
LD 1040 – An Act to Raise the Cap on Retirement Benefits for Certain State Employees and Teachers to Which a Cost-of-living Adjustment Is Made
Summary: This bill would raise the benefit base on which a cost-of-living adjustment (COLA) is applied to $40,000 as of July 1, 2026.
LD 1236 – An Act to Address Employee Retention of State Employees Who Are Firefighters at Bangor International Airport
Summary: This bill would establish a special service retirement plan for firefighters employed by the Maine Department of Defense, Veterans and Emergency Management at Bangor International Airport.
LD 1383 – An Act to Require State Divestment from Perpetrators of International Human Rights Violations
Summary: This bill would prohibit the State from investing public funds or entering into procurement contracts with companies, entities, persons or financial institutions involved with entities determined by international bodies to have committed certain violations of human rights.
LD 1611 – An Act to Decrease the Retirement Contributions Required for Teachers and State Employees
Summary: This bill would decrease the required employee contributions for the State/Teacher Plan from 7.65% of earnable compensation to 6.2% of earnable compensation.
LD 1872 – An Act to Reinvest in the Pension Funds of the Maine Public Employees Retirement System
Summary: This bill would establish the Retirement Improvement Fund to receive transferred funds equal to the difference between payments made toward the obligation for the unfunded actuarial liability (UAL) in the year the funds are transferred and the amount of those payments in FY28. The funds would be used to increase the Benefit Base upon which cost-of-living adjustments (COLA) are made until the Benefit Base reaches $40,000.
LD 2022 – An Act to Clarify the Setting of Group Life Insurance Coverage Levels Under the Maine Public Employees Retirement System
Summary: This bill changes the source of information used to set up group life insurance (GLI) coverage levels under the Maine Public Employees Retirement System.
LD 2067 – An Act to Include Certain Community Mental Health Workers Under the 1998 Special Plan
Summary: This bill would change the plan in which certain employees of the Department of Health and Human Services participate from a regular plan to a special plan.
LD 2085 – An Act to Modify Service Retirement Provisions to Include Additional Emergency Communications Positions in the 1998 Special Plan
Summary: This bill would move 2 positions to the 1998 Special Plan at the request of the Department of Public Safety.
LD 2093 – An Act to Codify and Update a Provision of Private and Special Law Governing Temporary Disability for State Employees
Summary: This bill would codify in Title 5 the temporary disability program for confidential state employees that currently exists in Private and Special law.
LD 2145 – An Act to Decrease Offsets to Disability Retirement Benefits
Summary: This bill would increase from 80% to 100% the percentage of a person’s average final compensation which may be the total of MainePERS disability retirement benefits and workers’ compensation benefits before the offset of workers’ compensation benefits begins.
