Rulemaking
 

MainePERS is in the process of rulemaking on several rules.  A brief description of the upcoming rulemaking is as follows:

Chapter 101 – Earnable Compensation and Average Final Compensation Calculation

This rule governs the computation of average final compensation used in the calculation of retirement benefits paid by MainePERS.  The proposed amendments to the rule clarify the inclusion of:  1) paid time off, 2) sick and vacation leave for Participating Local District members, and 3) certain arbitration awards, judgments and written settlements as earnable compensation.  The proposed amendments also correct some minor formatting issues.

Chapter 406 – Purchase of Creditable Service
This rule governs the purchase or repurchase of service credit.  The proposed amendments to the rule incorporate recent changes in law to permit the purchase of prior law enforcement service.  The proposed amendments also correct some minor formatting issues.

Chapter 803 – Participating Local District Consolidated Retirement Plan 
This rule governs the Consolidated Retirement Plan for Participating Local Districts (PLDs).  The proposed amendments to the rule incorporate recent changes in law to:  1) permit PLD employers to cover dispatchers by a special plan, and 2) permit the purchase of prior law enforcement officer service.  The proposed amendments also include some adjusted wording on unrelated technical provisions of the rule.



Public hearings on these proposed rule amendments are scheduled for 1:00 p.m. on
September 12, 2019 in the MainePERS Board Room at 139 Capitol Street, Augusta, Maine. 

The proposed amended rules may be viewed on this web site via the links above, or a copy may be obtained by contacting the Executive Director’s office at 1-800-451-9800.  Written comments may be submitted via email at rulemaking@mainepers.org, or through regular U.S. mail at MainePERS, P.O. Box 349, Augusta, ME  04332-0349.  Written comments must be received no later than 5:00 p.m. on September 23, 2019.
